OVERVIEW
This website is operated by MODDED AUTOMOTIVE LIMITED (“we”, “us”, “our”).
MODDED AUTOMOTIVE LIMITED is an independent automotive specialist primarily focused on the supply and professional installation of aftermarket and OEM (Original Equipment Manufacturer) automotive products, including retrofits, upgrades and vehicle enhancement services.
Software coding and programming services may be provided where necessary to support installation or enable functionality, but coding is not the primary focus of our business.
We specialise in various German vehicle brands including, but not limited to:
• BMW
• Volkswagen (VW)
• Audi
• Mercedes-Benz
• Porsche
All manufacturer names are used strictly for identification and compatibility purposes. MODDED AUTOMOTIVE LIMITED is not affiliated with, authorised by, or endorsed by any vehicle manufacturer unless expressly stated in writing.
By accessing our website, booking an appointment, or purchasing any product or service, you agree to be bound by these Terms of Service (“Terms”).
These Terms incorporate and must be read alongside our:

We reserve the right to update these Terms at any time. Continued use of our Services constitutes acceptance of any changes.
SECTION 1 – ELIGIBILITY
By agreeing to these Terms, you confirm that:
• You are legally capable of entering into a binding contract
• You will not use our products or Services for unlawful purposes
• You will comply with all applicable laws and regulations
We reserve the right to refuse Service at our discretion.
SECTION 2 – PRODUCTS & SERVICES
MODDED AUTOMOTIVE LIMITED primarily provides:
• Supply of aftermarket automotive products
• Supply of OEM automotive products
• Professional installation of aftermarket components
• Professional installation of OEM components
• Retrofit and upgrade services
• Vehicle enhancement and modification services
Where required to support installation, we may also provide:
• Software coding
• Software programming
• Control unit configuration
• Software flashing
Products supplied may be new, used, refurbished, reconditioned or modified unless expressly stated otherwise.
Compatibility depends on vehicle model, year, hardware specification and software level. Responsibility for confirming compatibility remains with the customer unless confirmed in writing by us.
SECTION 3 – AFTERMARKET PRODUCTS
Aftermarket products are not manufactured, endorsed or approved by any vehicle manufacturer.
Customers acknowledge that aftermarket products:
• May differ from OEM specifications
• May not match OEM quality, finish or durability
• May exhibit minor variations in behaviour
• May operate differently depending on vehicle software
This may include:
• Audio differences
• Display variations
• Software inconsistencies
• Temporary warnings
Minor glitches or intermittent behaviour are normal within the aftermarket automotive sector and do not constitute defects.

SECTION 4 – OEM PRODUCTS
OEM products may include:
• New OEM components
• Used OEM components
• Refurbished or reconditioned components
• Modified OEM components
Unless explicitly stated in writing, OEM products are not guaranteed to be brand new.
Used or refurbished OEM parts may show cosmetic wear.
Dealer or manufacturer software updates may remove installed functionality. We are not responsible for such changes.
SECTION 5 – INSTALLATION & LABOUR
Labour charges are non-refundable once work has commenced.
Certain installations may be partially or fully non-reversible. Where applicable, this will be disclosed prior to installation.
Once installation has been completed and functionality demonstrated, responsibility transfers to the customer.
SECTION 6 – SOFTWARE CONFIGURATION & FLASHING
Software coding or programming may be required to enable functionality following installation.
Standard coding:
• Is non-invasive
• Is reversible where supported
• Does not overwrite core manufacturer firmware unless expressly stated
Software flashing modifies control unit data and carries inherent risk including but not limited to:
• Software corruption
• Module malfunction
• Loss of vehicle functionality
By proceeding, the customer acknowledges and accepts these risks.
We are not responsible for failures caused by pre-existing faults, low battery voltage, third-party interference, or manufacturer software updates.
SECTION 7 – IN-PERSON INSTALLATION (UK ONLY)
We currently operate from:
• London Base (RM6 4TD)
• Manchester (mobile installation arranged upon booking)
• Bradford (mobile installation arranged upon booking)
Appointments are subject to engineer availability and confirmation.
Customer Responsibilities
The customer must ensure:
• Vehicle is accessible at the agreed time
• Safe working conditions are available
• Vehicle battery is adequately charged
• Keys and access are provided
Failure to meet these requirements may result in cancellation and forfeiture of deposit.
Missed Appointments
• Minimum 24 hours notice required for cancellation
• Late cancellations may result in deposit forfeiture
• No-shows may require full rebooking payment
• Travel costs may be charged if engineer attends and access is not provided
Appointment times are estimates only.
SECTION 8 – DEPOSITS & PAYMENTS
Deposits may be required to secure bookings or order parts.
Deposits:
• Are deducted from the final balance
• Are non-refundable if cancelled within 24 hours
• May be transferable once at our discretion
• May be forfeited after repeated rescheduling
Deposits represent consideration for reserving engineer time and allocating parts.
We reserve the right to refuse work until full payment is received.
Unjustified chargebacks or payment disputes may result in suspension of support and recovery action.
SECTION 9 – DISTANCE SELLING & COOLING-OFF RIGHTS
Under UK Consumer Contracts Regulations, customers may have a 14-day cooling-off period for distance purchases.
However:
• Bespoke or custom-made goods are exempt
• Services begun with customer consent within the 14-day period waive cancellation rights
By requesting work to begin within 14 days, you expressly consent to commencement and acknowledge that cancellation rights are waived once work has started.
SECTION 10 – VEHICLE DATA & BACKUPS
Customers are responsible for backing up any vehicle data prior to installation or coding.
We are not liable for loss of:
• Media
• Contacts
• Navigation data
• Vehicle settings
Certain installations or software procedures may reset vehicle systems.
SECTION 11 – STORAGE & RIGHT OF RETENTION
If a vehicle remains in our possession and:
• Payment is not made
• Collection is unreasonably delayed
We reserve the right to:
• Charge reasonable daily storage fees
• Retain possession of the vehicle until payment is received
This right is exercised in accordance with UK law.
SECTION 12 – WARRANTY & MANUFACTURER UPDATES
Installation or coding does not automatically void manufacturer warranty unless core firmware is overwritten.
Manufacturer dealerships may remove modifications during updates.
We are not responsible for changes made by third parties.
SECTION 13 – INTELLECTUAL PROPERTY
All website content, installation methods, coding configurations and documentation remain the intellectual property of MODDED AUTOMOTIVE LIMITED.
Unauthorised reproduction or commercial use is prohibited.
SECTION 14 – FORCE MAJEURE
We are not liable for delays or failure to perform due to events beyond our reasonable control, including but not limited to:
• Weather
• Illness
• Supplier delays
• Travel disruption
• Government restrictions
• Technical system failures
SECTION 15 – DISCLAIMER OF WARRANTIES
All products and Services are provided “as is” and “as available.”
We do not guarantee uninterrupted or error-free operation.
SECTION 16 – LIMITATION OF LIABILITY
Nothing in these Terms excludes liability for:
• Death or personal injury caused by negligence
• Fraud
• Any liability that cannot legally be excluded under UK law
Subject to the above, our total liability is limited to the value of the product or Service purchased.
We are not liable for indirect or consequential losses including:
• Loss of profit
• Vehicle downtime
• Loss of opportunity
• Loss of data
SECTION 17 – INDEMNIFICATION
You agree to indemnify and hold harmless MODDED AUTOMOTIVE LIMITED from claims arising from:
• Your breach of these Terms
• Pre-existing vehicle faults
• Third-party modifications
• Misuse of products
SECTION 18 – SEVERABILITY
If any provision is unenforceable, the remainder remains valid.
SECTION 19 – TERMINATION
We may terminate Services for breach of these Terms.
Obligations incurred prior to termination survive termination.
SECTION 20 – ENTIRE AGREEMENT
These Terms and related policies constitute the entire agreement between you and MODDED AUTOMOTIVE LIMITED.
SECTION 21 – GOVERNING LAW
These Terms are governed by the laws of England and Wales.
